Assaulting the same child a co-worker repeatedly abused won’t mean a criminal record for a Calgary daycare worker, a judge ruled Tuesday.

Justice Mark Tyndale accepted submissions from defence counsel Jamil Sawani that a conditional discharge for Mursal Akbari was warranted.

If the Calgary woman completes a 24-month probationary period, which includes seeking counselling and completing 150 hours of community service, she will have no criminal conviction on her record.
