RG Kar Case: Sandip Ghosh May Get Death Penalty If Found Guilty. This Is What The Court Said

Former RG Kar Medical College and Hospital Principal Sandip Ghosh has been denied bail by a CBI court amid the ongoing probe in the rape and murder of a 31-year-old doctor at the hospital in Kolkata. The court observed that the nature and gravity of the accusation against him are "grave" to attract capital punishment if proven. 

Ghosh took moral responsibility and resigned from the post amid uproar over the incident that took place on August 9. Within hours, the West Bengal government appointed him as the principal of Calcutta National Medical College and Hospital. The horrifying crime led to state-wide protests against the West Bengal government. Sanjay Roy, a Kolkata Police civic volunteer, has been arrested in connection with the case. 

"Accusations Fall Under Rarest Of Rare Cases"

Additional Chief Judicial Magistrate S Dey observed that the nature and gravity of the accusations against Ghosh qualify to fall under the rarest of rare cases category. The judge said that the court is of the opinion that it would be injustice flouting the principle of equity to release the accused on bail.

The court disagreed when Gosh's counsel claimed that he was falsely implicated in the case, and that there was no act on his part to commit the crime as alleged. The court observed in its order that a person may commit an offence with the help of others and there is no need to be present for the other accused at the place of occurrence. 

Ghosh was arrested for allegedly misleading the investigation and for his alleged role in the destruction of evidence by not declaring the death of the victim immediately and the considerable delay in registration of the FIR. CBI also accused Ghosh of willfully being absent from the scene instead of closely monitoring proceedings, taking the necessary steps to preserve evidence and getting the FIR registered at the earliest.

There have been complaints of financial irregularities on multiple counts at the hospital during Ghosh's tenure as principal. The bail plea of Abhijit Mondal, accused of allegedly tampering with evidence and delay in filing of FIR in the rape and murder, was also rejected. He is the former officer in-charge of Tala police station under whose juridiction the hospital falls. 

The female doctor was found with severe injuries in the seminar hall of the state-run RG Kar Hospital in Kolkata. The CBI has also has questioned Apurba Biswas, head of the three-doctor panel that conducted the post-mortem investigation.
