Jail for nighttime prowling

A Vernon man with a lengthy criminal record and history of addiction issues was sentenced to 150 days jail Wednesday.

Marc Anthony Zukowsky, 44, pleaded guilty to two counts of trespassing at night, one count possession stolen property under $5,000, and one count of having in his possession and using a stolen credit card.

Court heard Zukowski was caught on security camera prowling through at least two Coldstream properties and rummaging through cars on July 15.

On the same evening, Zukoswki had in his possession, and used, a visa card that was not his own.

Zukowski was arrested on July 18 and Mounties found him with cheques from Vernon’s Italian Kitchen and its owner. Crown counsel Tiffany Zanatta said the cheques had been stolen before they were found on Zukowski.

Defence counsel Claire Mastop explained Zukowski was diagnosed with PTSD after a traumatic injury at work about seven years ago.

“He advised me that after that incident, drug issues turned into addiction issues with crack, and he advises that he managed to get off the crack four years ago,” said Mastop in court.

Provincial court judge Richard Hewson said Zukowski is currently struggling with fentanyl use and is living in a tent in Vernon.

“He has a number of employable skills, including as a truck driver, electrician. He works part time for his father. He receives support from the province as a person with a disability," said Hewson.

Zukowski was sentenced to 150 days total jail time. After credit for time already served, he will spend 16 days in jail before being released. He will then be on a 12-month probation where he is to have no contact with the victims or go to their addresses. Zukowski must also not possess any identification other than his own and pay $400 in fines.
