Charged in fatal stabbing

Nearly two years after a 33-year old man was fatally stabbed in downtown Kelowna, a man has been charged with murder.

In a press release Saturday morning, Sgt. Laura Pollock of the Kelowna RCMP says 43-year-old Tyler Sutter was arrested Friday and has been charged with the second-degree murder of Devon Foster.

Foster was stabbed after midnight on Oct. 9, 2022 outside the downtown Kelowna Cactus Club on Water Street. Police said they were called to the area for a report of an altercation amongst a group of people.

Responding officers found Foster lying in the grass when they arrived, as another man performed life-saving measures on him. But Foster was pronounced dead at the scene.

Just shy of the two-year anniversary of Foster's death, police have arrested his alleged killer.

“These types of investigations are complex and need to be done methodically and thoroughly in order to protect the integrity of the investigation,” Sgt. Pollock said. “This investigation is now with the BC Prosecution Service, as such, the RCMP will not be providing any further details.”

While Sutter has now been arrested, it appears he's been the target of the RCMP's investigation for some time. Court records show police successfully applied to further detain Sutter's seized items back in August 2023, which was likely part of the murder investigation.

Sutter remains in custody after his arrest Friday. His first court date has not yet been set.

He has a minor criminal record dating back to a 2000 conviction for possessing drugs in Hope. Other convictions include resisting arrest in 2003 and 2008 and driving while prohibited in 2009.

Foster left behind his partner and young daughter, who was two years old at the time of his death. His estranged mother told Castanet she had wished she had seen him one last time before his death.
