Plymouth Court List: Woman who failed to look after dogs among 28 in trouble

Magistrates are still dealing with people who are drinking or taking drugs before driving their vehicles on public streets

A week of court appearances has revealed a slew of offences by people who have decided to play fast and loose with the law. Some have found themselves hauled downstairs to the cells at Plymouth Magistrates' Court by stern-faced dock officers, before they are later brought out the back of the building in handcuffs and helped up the steps of a waiting van prior to their sombre journey to a prison.

Occasionally they face a prison sentence because magistrates decide they were deemed to have had a "flagrant disregard for court orders" or a "flagrant disregard for people and their property" or they just decided to commit crimes while on bail or on a suspended sentence.

However, magistrates are not without a sense of understanding which can be shown in the driving offence cases where they have chosen not to remove a licence due to "mitigating circumstances".

The circumstances invariably are to do with the overwhelming impact not just on the driver, but on the drivers' family or others closely connected to them.

Cases in court can include someone who has poorly family members and the loss of the licence could result in "exceptional hardship" upon them, such as being unable to take them to vital hospital appointments for treatment. Or it may be an small business employee whose loss of a driving licence would result in the loss of their business and their employees losing their jobs.

While PlymouthLive will report on the nature of the offences and the sentences handed down, we will only add whether or not there was a report of mitigating circumstances prior to the sentence, but not details.

Despite the mitigating circumstances being read out in a public court, we choose not to report the details in these court list articles as they are often of an exceptionally personal and distressing nature.

In effect, we feel it is enough for readers to know that mitigating circumstances have been put forward by the offender themselves or their legal representative, and that the magistrates or District Judge have considered these matters to be pertinent before they have handed down their judgement.

Drove electric motorcycle without suitable insurance on two occasions. Drove electric motorcycle otherwise in accordance with a licence on two occasions. Fined £200 Driving record endorsed six points.

ROBBIE MATTHEW HILBORNE, aged 32 of Stowe Gardens, Plymouth: Drove vehicle on Poole Park Road without suitable insurance. Fined £155. Victim surcharge £62,. Court costs £85. Disqualified from driving for six months. Driving record endorsed six points.

ALISON RACHAEL LIST, aged 38 of Robins Way, Plymstock : Drove on Laira Bridge Road while using a hand-held mobile telephone. Mitigating circumstances. Fined £200. Victim surcharge £80. Court costs £90. Driving record endorsed six points.

NIGEL MOORE, aged 68 of Charlotte Street, Plymouth: Failed on two occasions to provide information relating to identity of driver alleged to have been guilty of offence. Fined £200. CLAIRE LOUISE ROPER, aged 44 of Victoria Road, Plymouth: Caused unnecessary suffering to mastiff type dog known as Athena and a Staffordshire bull terrier type dog known as Hazel by failing to adequately investigate or address the causes of their underweight or poor bodily conditions. Caused unnecessary suffering to mastiff type dog known as Athena and a Staffordshire bull terrier type dog known as Hazel by failing to to provide adequate or effective professional veterinary care and attention for their skin disease. Did not take steps to ensure the needs of an animal - namely a mastiff type dog known as Athena, a Staffordshire bull terrier type dog known as Hazel and a chihuahua type dog known as Apollo - were met to the extent required by good practice in that their need for a suitable environment, their need for a suitable diet including continuous access to an adequate supply of clean fresh drinking water and their need to be protected from pain, suffering, injury or disease. Community order - Mental Health Treatment Requirement for 12 days. Rehabilitation Activity Requirement up to 20 days. Fined £80. Victim surcharge £114. Court costs £400.
